En este trabajo se ofrece un acercamiento desde el derecho a los análisis promovidos por las teorías institucionalistas, y conecta esos análisis con una concepción esencial de democracia y dos problemas de las democracias latinoamericanas: la subrepresentación de las mujeres en los parlamentos y el clientelismo político en el marco de la distribución de planes sociales. Para ello, se comienza con una aproximación al concepto de instituciones informales, que es central en los análisis institucionalistas, y se reconocen dos diferentes tipos (...) de instituciones informales con distintas características. Luego de ofrecida una concepción esencial de democracia y sus condiciones y condicionantes, se realiza un análisis de cómo las instituciones informales han afectado la eficacia y efectividad de las normas jurídicas dictadas para promover las cuotas de género en las elecciones parlamentarias y, como contracara, se muestra cómo un diseño adecuado de los programas de distribución de planes sociales ha logrado neutralizar instituciones informales tales como el clientelismo y la pequeña corrupción, que afectaban de manera directa a las democracias latinoamericanas. Finalmente se proponen ciertas ideas sobre la relevancia del buen diseño legislativo y su vinculación con las instituciones informales. (shrink)

El objetivo de este texto es investigar sobre los posibles puntos de encuentro entre la psicoterapia existencial, un paradigma psicológico arraigado en las filosofías de la existencia, y el posicionamiento del profesor Marino Pérez Álvarez, quien se define a sí mismo como conductista radical, respecto a su manera de entender la existencia humana y el modelo más adecuado de psicoterapia. Para ello se proponen seis puntos de encuentro: necesidad de una fundamentación filosófica para la psicología, crítica al cientificismo y al (...) modelo médico, interpretación de los trastornos mentales como problemas de la vida cotidiana, recuperación del paciente como protagonista de la terapia, crítica a la psicología positiva y crítica al dualismo cartesiano. Little has been studied on the relationship between affect and school problems related with attendance. This study aims to identify different affective profiles and to determine whether these profiles differ from each other based on the four functional conditions of school refusal behavior. Participants comprised 1,816 Spanish adolescents aged 15–18 years. The Positive and Negative Affect Schedule for Children-Short Form and the School Refusal Assessment Scale-Revised for Children were administered. Latent profile analysis revealed five affective profiles: low affective profile, self-fulfilling (...) profile, low positive affect profile, self-destructive profile, and high affective profile. The self-destructive profile revealed the highest average scores in the first three factors of the SRAS-R-C, whereas the high affective profile reached the highest average score in the fourth factor. On the contrary, the self-fulfilling profile obtained the lowest average scores in the first two factors of the SRAS-R-C, whereas the low affective profile revealed the lowest average scores in the last two factors. Findings suggest the relevance of developing more adaptative affective profiles, such as the self-fulfilling profile, which would contribute to diminishing school attendance problems. (shrink)

Durante la escolarización a todo individuo se le pueden presentar situaciones escolares que pueden desencadenar miedos. Este estudio pretende examinar las diferencias en rechazo escolar según altas y bajas puntuaciones en ansiedad anticipatoria y analizar la capacidad predictiva del rechazo escolar sobre la ansiedad anticipatoria. Participaron 879 estudiantes españoles entre los 8 y los 11 años. Los estudiantes con altas puntuaciones en ansiedad anticipatoria obtuvieron puntuaciones medias superiores en rechazo escolar y este fue un predictor positivo y estadísticamente significativo de (...) ansiedad anticipatoria en la mayoría de los casos. Patients’ beliefs about the effectiveness of their treatments are key to the success of any intervention. However, since these beliefs are usually formed by sequentially accumulating evidence in the form of the covariation between the treatment use and the symptoms, it is not always easy to detect when a treatment is actually working. In Experiments 1 and 2, we presented participants with a contingency learning task in which a fictitious treatment was actually effective to reduce the symptoms of fictitious patients. (...) However, the base-rate of the symptoms was manipulated so that, for half of participants, the symptoms were very frequent before the treatment, whereas for the rest of participants, the symptoms were less frequently observed. Although the treatment was equally effective in all cases according to the objective contingency between the treatment and healings, the participants’ beliefs on the effectiveness of the treatment were influenced by the base-rate of the symptoms, so that those who observed frequent symptoms before the treatment tended to produce lower judgments of effectiveness. Experiment 3 showed that participants were probably basing their judgments on an estimate of effectiveness relative to the symptom base-rate, rather than on contingency in absolute terms. The current COVID-19 crisis may have an impact on the mental health of professionals working on the frontline, especially healthcare workers due to the increase of occupational psychosocial risks, such as emotional exhaustion and secondary traumatic stress. This study explored job demands and resources during the COVID-19 crisis in predicting emotional exhaustion and STS among health professionals. The present study is a descriptive and correlational cross-sectional design, conducted in different hospitals and health centers in Spain. The sample consisted of 221 (...) health professionals with direct involvement in treating COVID-19. An online survey was created and distributed nationwide from March 20 to April 15 which assessed: sociodemographic and occupational data, fear of contagion, contact with death/suffering, lack of material and human protection resources, challenge, emotional exhaustion, and STS. Descriptive findings show high levels of workload, contact with death/suffering, lack of MHPR and challenge, and are moderately high for fear of contagion, emotional exhaustion, and STS. We found an indirect significant effect of lack of MHPR on predicting emotional exhaustion through the workload and on STS through fear of contagion, contact with death/suffering, and workload. To conclude, this study examines the immediate consequences of the crisis on health professionals' well-being in Spain, emphasizing the job demands related to COVID-19 that health professionals are facing, and the resources available in these health contexts. These findings may boost follow-up of this crisis among health professionals to prevent them from long-term consequences. (shrink)

Desde la separación estricta de ética y derecho, la Rechtslehre kantiana sostiene que es la ética la que exige al sujeto que haga suya la máxima de actuar conforme al derecho. En la misma línea defiende J. F. Kervégan que los sujetos habríamos de reconocer como un deber ético el respeto a las normas jurídicas, sin que esto quiera decir que el derecho dependa de la ética, pues en estricto derecho no podría tenerse a la intención de conciencia como móvil (...) de la acción justa. Lo que el derecho regula y juzga son las acciones exteriores, y también el móvil tiene que es el poder coercitivo, que el derecho, a diferencia de la ética, tiene la facultad de imponer a la sociedad a fin de que cada miembro de ella en su acción externa evite por su propio interés perjudicar la libertad de cualquier otro. Por esta unicidad del móvil sostiene Kant que derecho y facultad de coaccionar significan una y la misma cosa. El formalismo de su planteamiento impide a Kant entrar en la complejidad del entramado de derechos y deberes, de bienes y cargas, que hace de la justicia distributiva el verdadero objeto del arte jurídico. Y por su externalización estricta del derecho reduce al jurista a la observancia de los textos, ignora el procedimiento de la controversia judicial, excluye la equidad como ajena al derecho, y convierte al derecho en el gendarme de la moral . En cuanto a la intención interior, una cosa es que las leyes no puedan motivar el albedrío por la conciencia de la obligación, y otra que si derecho y coacción significaran lo mismo no habría diferencia entre cumplir la ley para evitar el castigo o eludir el castigo burlando la ley -opción ésta que a muchos resultaría más provechosa, dado que el poder del Estado es incapaz de vigilar en cada momento a cada sujeto, y que los vigilantes mismos necesitan ser vigilados, ad infinitum. Tras una breve alusión a los conocidos argumentos de Platón, Hobbes y Montesquieu sobre la obediencia voluntaria como el otro móvil del derecho, no menos necesario que la coerción, se recuerda que también el profesor Kervégan ha defendido en otro contexto que un orden jurídico cualquiera tiene dos componentes irreductibles entre sí: el sistema de normas que define lo que debe ser y la decisión que conforma el ser al deber-ser. Finalmente, en el derecho interestatal no puede Kant invocar la facultad de coaccionar, que deja de significar lo mismo que "derecho" porque, al no haber ninguna fuerza superior a la soberanía de los Estados, el pacto durará hasta que alguno de ellos lo incumpla por su libre y soberana decisión. From a firm distinction between ethics and right, the Kantian Rechtslehre holds that the demand to adopt the maxim to act according to the right is an ethical demand. Also J.F. Kervégan defends that individuals should recognize the ethical obligation to respect juridical rules, but this does not mean that right depends on ethics, because, in strict right, internal disposition or intention could not be considered as motive for the rightful action. Law regulates and judges the external actions and also the motive has to be external as it is external the coercion that right -but not ethics- can impose on society so that each member of it, for his own interest, does not damage in his external agency any other member's freedom. Because of this only one motive, Kant declares that right and coercion's capacity signify the same thing. His formalist position stops him to go into the complex network of rights and duties, of advantages and burdens, which makes distributive justice the true subject of juridical art. Moreover, because of the strict externals of the law Kant is unaware of the juridical controversy, reduces the jurist to the observance of texts, ejects the equity as not right's own, and risks to transform the right in the gendarme of morals . With regard to intention, one thing is that in strict law the internal disposition can not be deemed as the motive, and other thing is that if law and coercion's capacity signify the same thing, there is no difference between obeing the law to avoide the punishment, or avoiding the punishment in breaking the law; then, the last option would be profitable for too many people, since the coercion power is not able to survey in every moment each individual, and the watchmen themselves need to be watched over and so on. After a short mention of the well known Plato, Hobbes and Montesquieu's arguments about the voluntary obedience as the other motive of the strict right, not less necessary than coercion, we remember that J. F. Kervégan also defended in another context that any juridical order has two irreducible le système des normes générales qui définissent ce qui doit être, et la décision qui conforme l'être au devoir-être. Finally, in the interstates right, Kant can not maintain that right and capacity of coercion mean the same thing, because there is not any force over the sovereignty of the States, and therefore the contract will last till one of them breaks it by its free and sovereign decision. In this paper we provide a summary of the discussions between Villey and Tierney concerning the rise of a concept of subjective right in late medieval thought, William of Ockham’s place in it, and the differences of this subjective notion with regards to an objective notion of right. Afterwards, we analyze Ockham’s main texts. According to the authors, Ockham’s notion of a natural right of the individual bears a relationship both to a rational concept of morality and to his characteristic (...) emphasis on the free choice of the will. This paper is a comparative analysis of the Logica Campsale Anglici, valde utilis et realis contra Ocham , from an anonymous author known as pseudo Richard of Campsall, and Ockham’s Summa logicae , in answer to which the former was written. We summarize both authors’s fundamental positions on five key issues: 1) the synonymy between abstract and concrete terms, 2) the reference of primary and secondary intentions, 3) the nature of the relations of predication between terms in propositions, 4) the (...) status of the “passions of the soul” and 5) the prime signification of spoken words. Early 20th century Futurist attempts in visual poetry can be related to technology-based poetic creation and current digital experiences. This essay seeks to enhance the understanding of Media Poetry by identifying the existing connections between the “words in freedom” and Eduardo Kac's Holopoetry. This example of interactive and immaterial creation represents a crucial contribution to redefine poetry‟s relevance to contemporary global networks and also a milestone to understand the future of virtual and immersive writing spaces.

Este artículo se inscribe en el marco teórico de la teoría fílmica feminista y analiza la forma en que el cine, como aparato ideológico, articula mensajes de violencia que contribuyen a la dominación masculina. En primer lugar, se introducen los distintos objetivos y corrientes metodológicas que han configurado la teoría fílmica feminista desde su nacimiento en la década de 1970. En segundo lugar, se realiza una breve aproximación a las características de la violencia simbólica, según la definición del sociólogo francés (...) Pierre Bourdieu, para identificar sus nexos con la teoría fílmica feminista. Así, se explora la presencia de la violencia simbólica en los textos audiovisuales como herramienta ideológica para sostener los mandatos de género y su posible aplicación como categoría de análisis. Por último, se justifica la necesidad de incorporar una educación audiovisual feminista en los programas didácticos. A modo de conclusión, se exponen una serie de características del rol femenino en la estructura social dominante y también se incluyen algunas indicaciones para combatir la violencia simbólica. Estas dos grandes potencias han jugado un importante papel en la configuración del sistema internacional. Con este artículo se pretende realizar un análisis de la política exterior de Rusia, -desde el enfoque realista de las relaciones internacionales- el cual no puede desprenderse de un estudio paralelo que haga referencia al comportamiento de Occidente en (...) general, y en particular de los Estados Unidos de América. Este artículo presenta algunas de las visiones filosóficas más influyentes sobre la memoria, la verdad y la justicia en el Medioevo cristiano. En todasellas están presentes, en proporción diferente, las dos tradiciones dominantes, el neoplatonismo y el aristotelismo. San Agustín, Avicena y Tomás de Aquino encarnan perspectivas crecientemente desplatonizadas sobre la memoria. En cuanto al concepto de verdad, tanto el modelo teocéntrico de Agustín como el adecuacionista de Tomás son expresiones de una corriente principal que declina en el siglo XIV. (...) Finalmente, mientras que Agustín introduce de modo crítico la definición ciceroniana de la justicia, basada en la teoría grecorromana de la ley natural, Aquino coordina sistemáticamente teísmo cristiano, ley natural y naturalismo político aristotélico. XIX la psicología exigiera su reconocimiento como ciencia independiente, se ha ido separando progresivamente de la religión, llegando a caer en una perspectiva reduccionista que niega la dimensión espiritual del ser humano. Sin embargo, la psicoterapia existencial de Rollo May, profundamente influida por el teólogo existencialista Paul Tillich, es un ejemplo de cómo la práctica terapéutica no solo no está enfrentada a la religión, sino que incluso puede obtener de ella ciertas orientaciones de vital importancia (...) para su quehacer. We explored the home learning environments of 173 Mexican preschool children in relation to their numeracy performance. Parents indicated the frequency of their formal home numeracy and literacy activities, and their academic expectations for children’s numeracy and literacy performance. Children completed measures of early numeracy skills. Mexican parent–child dyads from families with either high- or low-socioeconomic status participated. Low-SES parents reported higher numeracy expectations than high-SES parents, but similar frequency of home numeracy activities. In contrast, high-SES parents reported higher frequency (...) of literacy activities. Path analyses showed that operational numeracy activities were positively related to children’s numeracy skills in the high- but not in the low-SES group. These findings improve the understanding of the role of the home environment in different contexts and provide some insights into the sources of the variable patterns of relations between home learning activities and children’s numeracy outcomes. They also suggest that SES is a critical factor to consider in research on children’s home numeracy experiences. (shrink)

On 20 December 1973, an attack by ETA put an end to the lives of Franco's head of government, his chauffeur and his bodyguard. This had important consequences for both the dictatorship and the terrorist group. Based on the existing sources, historians have developed a fairly credible account of the events. Nevertheless, the fact that ETA had managed to assassinate such a prominent politician, combined with some loose ends in the police investigation and the absence of a sentence gave rise (...) to all kinds of speculation. Furthermore, the case of Carrero Blanco has inspired narratives of uneven quality. Health professionals are especially exposed to stress, with consequences on professionals’ health and wellbeing. However, palliative care professionals’ wellbeing has been the subject of very little research. The aim of this work is to study the Personal Wellbeing Index in a sample of Spanish palliative care professionals, as well as to study their levels of wellbeing and the relationships of wellbeing with variables such as gender, age, marital status, profession, and professional quality of life. A cross-sectional survey of Spanish palliative (...) care professionals was conducted. The Spanish version of the PWI and the Short version of the Professional Quality of Life Scale were used. Here, 296 palliative care professionals attending patients at the end of life participated in the study. They showed medium to high levels of wellbeing. The PWI showed an adequate internal structure [χ2 = 116.130 ]; Comparative Fit Index = 0.970; standardized root mean square residual = 0.041; root mean square error of approximation = 0.140 ] and excellent estimates of reliability [α = 0.879 and Composite Reliability Index = 0.923]. Wellbeing was higher for married compared to single and showed no relation with age, gender, and profession. Additionally, a structural equation model was estimated, in which a positive relation was found between wellbeing and compassion satisfaction and a negative one with burnout. The PWI is adequate to measure personal wellbeing in Spanish palliative care professionals. (shrink)

The aim of this paper is to propose that the common horizon of the reflections of political philosophy in Latin America is the debate that has taken place to defend liberalism or go against it. The background of this is the reference to the social collective forms. In this context, Marxism has tried to respond from heterodox visions that recover the Latin American experience. En una excursión a los indios ranqueles , hay un pasaje en el que Lucio Mansilla configura un relato mítico destinado a justificar ante el cacique ranquel el derecho de los blancos sobre las tierras. La matriz interpretativa a partir de la cual Mansilla define específicamente las identidades culturales será revisitada en el discurso literario. En el presente trabajo analizaremos dos novelas argentinas contemporáneas –El oscuro de Daniel Moyano y Más liviano que el aire de Federico Jeanmaire– que recrean los (...) enfrentamientos de sus respectivos contextos de producción a la luz de las antinomias tramadas durante el siglo XIX y desmantelan los mecanismos a partir de los cuales las elites configuraron una imagen de la sociedad argentina como una comunidad blanca y europea. Las Comunidades de Castilla, como movimiento social y político, pueden caracterizarse como una tentativa de renovación de la monarquía carolina como forma de gobierno. El creciente conocimiento sobre la circulación de ideas políticas que informaron el corpus doctrinal comunero permite precisar conceptual y terminológicamente un debate revisitado con frecuencia sobre la naturaleza revolucionaria o no de tal proceso. Acudir a los textos de los principales sustentadores teóricos de las Comunidades, tanto como a los documentos de sus reivindicaciones, y no (...) solo a una interpretación de síntesis ex post, contribuye a perfilar el alcance sobre sus pretensiones de reforma respecto a la forma del Estado o a la forma del gobierno, sobre la base de la participación y la igualdad. Apoyarse en las nociones de régimen político y sistema político a la luz de tales textos permite una mejor comprensión del movimiento como reformista más que como revolucionario. (shrink)

The present study had two main aims: to determine whether deaf children show higher rates of key behaviors of ADHD and of Conduct Disorder—CD— than hearing children, also examining whether the frequency of these behaviors in deaf children varied based on cochlear implant use, type of school and level of receptive vocabulary; and to determine whether any behavioral differences between deaf and hearing children could be explained by deficits in inhibitory control. We measured behaviors associated with ADHD and CD in (...) 34 deaf and hearing children aged 9–10 years old, using the revised Spanish version of the Conners scale. We then assessed inhibitory control ability using a computerized Stroop task and a short version of the Attention Network Test for children. To obtain a measure of the level of receptive vocabulary of the deaf children we used a Spanish version of the Carolina Picture Vocabulary Test for Deaf and hearing-impaired children. Deaf children showed significantly higher rates of behaviors associated with ADHD and CD, and over 85% of cases detected with high risk of ADHD-inattentive type in the entire present sample were deaf children. Further, in the group of deaf children a negative correlation was found between receptive vocabulary and frequency of disruptive, aggressive, or antisocial behaviors associated with CD. However, inhibitory control scores did not differ between deaf and hearing children. Our results suggested that the ADHD-related behaviors seen in deaf children were not associated with a deficit in inhibitory control, at least in the interference suppression subcomponent. An alternative explanation could be that these behaviors are reflecting an adaptive strategy that permits deaf children to access information from their environment which is not available to them via audition. Worldwide, vulnerable neighbourhoods of large cities are often the scene of collective violent conflicts linked with migration and ethnic minorities’ struggles for social justice. However, urban conflicts of this kind have not taken place in Spanish cities with high immigration rates, even though the country has been deeply affected by two recent socioeconomic crises (2009 and 2020). This article reports findings of a study aimed at understanding what lies behind this apparent social peace. The research methodology was based on an (...) analysis of secondary socio-economic and socio-relational data from the Spanish Institute of Statistics and from key national surveys and reports. Results confirmed that immigrant population living in the country are strongly segregated in the lower strata of the labour and socioeconomic structure and have been disproportionately affected by the crises. However, research findings also pointed to the existence of strong closed support networks where social capital has been effective at palliating members’ disadvantage and unrest. Drawing on the Theory of Rupture Frames, we argue that this is a fragile and unsustainable social peace, rooted in social injustice, and anticipate that unless actively prevented, uncontrolled conflict will eventually emerge in main cities’ neighbourhoods in Spain. Political polarisation in the United States offers opportunities to explore how beliefs about candidates – that they could save or destroy American society – impact people’s thoughts, feelings, and behaviour. Participants forecast their future emotional responses to the contentious 2020 U.S. presidential election, and reported their actual responses after the election outcome. Stronger beliefs about candidates were associated with forecasts of greater emotion in response to the election, but the strength of this relationship differed based on candidate preference. Trump supporters’ (...) forecast happiness more strongly related to beliefs that their candidate would save society than for Biden supporters. Biden supporters’ forecast anger and fear were more strongly related to beliefs that Trump would destroy society than vice versa. These forecasts mattered: predictions of lower happiness and greater anger if the non-preferred candidate won predicted voting, with Biden supporters voting more than Trump supporters. Generally, participants forecast more emotion than they experienced, but beliefs altered this tendency. Stronger beliefs predicted experiencing more happiness or more anger and fear about the election outcome than had been forecast. These findings have implications for understanding the mechanisms through which political polarisation and rhetoric can influence voting behaviour. (shrink)

Si dejamos a un lado la teoría, son tiempos difíciles para el republicanismo y uno de sus conceptos centrales: la virtud cívica. A contramano de ello, cabe la pregunta respecto a las nociones aristotélicas que, en tal sentido, podrían pervivir en las sociedades complejas contemporáneas. Se repasarán algunos conceptos políticos clave del pensador estagirita y también de Marco Tulio Cicerón, autor romano que sigue sus pasos, para luego intentar actualizar aquellos elementos que, entendemos, aún pueden aplicarse a nuestras sociedades, mientras (...) que otros deberán ser dejados a un lado. Asimismo, en un momento de alta apatía en relación a la democracia, y de cierta anomia provocada por un individualismo exacerbado, entendemos que es clave la pregunta por la existencia, actualidad y posibilidades de la virtud cívica en el siglo XXI. Y, en caso de respuesta afirmativa a dicha posibilidad, cabe preguntarnos cuánto de aristotélico tendría hoy esa virtud. (shrink)

El objetivo de este artículo es mostrar que el marco conceptual que reduce la psiquiatría a una ciencia empírica, dejando al margen a la filosofía, es claramente insuficiente. Para ello se recupera la propuesta del psiquiatra Kurt Schneider y se muesran sus paralelos con fenomenólogos como Edmund Husserl o Max Scheler. El artículo se centra en la distinción entre motivo y causa, que es fundamental en la definición de neurosis y psicosis, y que es también el núcleo de la argumentación (...) de Husserl cuando aboga por la “actitud personalista”, frente a la “actitud naturalista”.
